Terms of Service

Template notice. These terms are a starting template provided with the platform. They are not legal advice and must be reviewed and adapted by counsel before they govern a live deployment or a paid engagement.
Agreement
These terms govern access to and use of the DiamondIQ platform and this marketing site, both operated by FERMLLC Technologies, the technology branch of Félix E. Rivera-Mariani, PhD LLC. By using the platform you agree to these terms; engagements with organizations may also be governed by a separate signed agreement, which controls where it conflicts with this template.
Accounts & access
The platform does not offer public self-signup. Organizations are onboarded by FERMLLC Technologies, and accounts for coaches and admins are provisioned with role-scoped access. You are responsible for safeguarding your credentials and for activity under your account.
Acceptable use
You agree not to:
- attempt to access data belonging to another team or tenant, or to bypass tenant isolation and access controls;
- upload unlawful content or data you are not authorized to share, including athlete data without proper consent;
- disrupt, probe, or reverse-engineer the service except as permitted by our responsible-disclosure process; or
- use the service to violate any applicable law.
Athlete & youth data
Organizations are responsible for obtaining the consent required to enter athlete data and for the accuracy of that data. For programs serving minors, a signed consent and data-retention agreement must be in place before real rosters are loaded, and the platform's youth-data protections apply as described in our Privacy Policy.
Intellectual property
The DiamondIQ software, brand, and site content are owned by FERMLLC Technologies and its parent. Data entered by an organization remains that organization's data; these terms do not transfer ownership of it to us.
Service availability
We work to keep the platform available and accurate but provide it on an “as is” and “as available” basis without warranties of uninterrupted operation. Specific service commitments, if any, are set out in an organization's signed agreement.
Limitation of liability
To the extent permitted by law, FERMLLC Technologies is not liable for indirect, incidental, or consequential damages arising from use of the service. Nothing here limits liability that cannot be limited under applicable law.
